A defesa do ex-mandat\u00e1rio pediu aos ministros que o caso fosse encaminhado para primeira inst\u00e2ncia, pois ele n\u00e3o tem mais foro por prerrogativa de fun\u00e7\u00e3o.<\/p>\n<p>No entanto, a maioria do colegiado rejeitou o pedido. O \u00fanico a divergir foi o ministro Luiz Fux, que defendeu a transfer\u00eancia do julgamento para o plen\u00e1rio da Corte.
