O anel, da Tiffany &#038; Co., vale mais de $ 70.000, de acordo com documentos legais. <\/p>\n<p>Johnson cancelou o noivado depois que encontrou mensagens de texto no telefone de Settino com outro homem e a acusou de ter um caso. Settino disse que o homem era um amigo plat\u00f4nico, mas Johnson exigiu o anel de volta, de acordo com o <em>Globo<\/em>.<\/p>\n<p>Em Massachusetts, \u201co doador do anel tem direito a que este seja devolvido se o noivado for &#8216;terminado sem culpa do doador&#8217;\u201d, diz o <em>Globo<\/em> escreveu, citando o <a href=\"http:\/\/masscases.com\/cases\/sjc\/339\/339mass457.html\">Caso judicial de 1959 de DeCicco v. Barker<\/a>.<\/p>\n<p>A decis\u00e3o do tribunal de primeira inst\u00e2ncia concluiu que n\u00e3o houve caso e que Johnson foi o culpado por cancelar o casamento. <em>Globo<\/em> escreveu. No ano passado, um tribunal de apela\u00e7\u00f5es reverteu a decis\u00e3o, ficando do lado de Johnson. <\/p>\n<p>Os advogados de Settino agora est\u00e3o pedindo ao SJC que restaure a decis\u00e3o original e mude a forma como o estado aborda essas disputas.  <\/p>\n<p>\u201cO processo de Settino argumenta que os tribunais n\u00e3o devem ser &#8216;\u00e1rbitros do fim dos relacionamentos rom\u00e2nticos&#8217; e pede que o SJC siga o estado de Montana e torne os an\u00e9is de noivado presentes irrevog\u00e1veis\u201d, disse o <em>Globo<\/em> escreveu.<\/p>\n<p>Johnson e sua equipe jur\u00eddica est\u00e3o se opondo a essa posi\u00e7\u00e3o alegando que \u201ca teoria da doa\u00e7\u00e3o condicional sem culpa \u00e9 a abordagem correta porque protege a institui\u00e7\u00e3o do casamento ao preservar a singularidade do anel de noivado em oposi\u00e7\u00e3o a qualquer outro presente\u201d. <\/p>\n<p>Este caso traz \u00e0 tona as complexidades da pol\u00edtica de g\u00eanero, com o potencial de mudar um precedente legal estabelecido h\u00e1 mais de 60 anos.
