Kennedy Jr. pick federal health officials for the incoming Trump administration has petitioned the government to revoke its approval of the polio vaccine, which for decades has protected millions of people from a virus that can cause paralysis or death.<\/p>\n<p>That campaign is just one front in the war that the lawyer, Aaron Siri, is waging <a href=\"https:\/\/www.nytimes.com\/2024\/12\/13\/health\/childhood-diseases-vaccines-preventable.html\">against vaccines of all kinds<\/a>.<\/p>\n<p>Siri has also filed a petition seeking to pause the distribution of 13 other vaccines; challenged, and in some cases quashed, COVID-19 vaccine mandates around the country; sued federal agencies for the disclosure of records related to vaccine approvals; and subjected prominent vaccine scientists to grueling videotaped depositions.<\/p>\n<p>Much of Siri\u2019s work \u2014 including the polio petition filed in 2022 \u2014 has been on behalf of the Informed Consent Action Network, a nonprofit whose founder is a close ally of Kennedy. Siri also represented Kennedy during his presidential campaign.<\/p>\n<p>Kennedy, President-elect Donald Trump\u2019s choice for health secretary, has said he does not want to take away access to any vaccines. But as he prepares for his confirmation hearing and plans a fresh health agenda, his continuing close partnership with Siri suggests that vaccine policy will be under sharp scrutiny. It is a chilling prospect to many public health leaders, especially those who recall the deadly toll of some vaccine-mediated diseases.<\/p>\n<p>At the Trump transition headquarters in Florida, Siri has joined Kennedy in questioning and choosing candidates for top health positions, according to someone who observed the interactions but insisted on anonymity to disclose private conversations. They have asked candidates about their views of vaccines, the person said.<\/p>\n<p>Kennedy has privately expressed interest in having Siri serve in the Health and Human Services Department\u2019s top legal job, general counsel. However, Siri has suggested he may have more influence outside the administration. Kennedy Jr., President-elect Donald Trump\u2019s pick to serve as secretary of health and human services, in New York on Thursday, Dec. 12, 2024. <i> \u2013 Doug Mills\/The New York Times<\/i><\/figcaption><\/figure>\n<p>He did not mention the petitions he has lodged on behalf of ICAN with the Food and Drug Administration, asking regulators to withdraw or suspend approval of vaccines not only <a href=\"https:\/\/static01.nyt.com\/newsgraphics\/documenttools\/e68bd8b142eb7bf0\/914e0b90-full.pdf\">for polio<\/a>, but also <a href=\"https:\/\/static01.nyt.com\/newsgraphics\/documenttools\/3167dd9d41b9395a\/34eb5611-full.pdf\">for hepatitis B<\/a>.<\/p>\n<p>Siri is also representing ICAN<a href=\"https:\/\/static01.nyt.com\/newsgraphics\/documenttools\/820cd0a4b8a70a36\/c7f12a75-full.pdf\"> in petitioning <\/a>the FDA to \u201cpause distribution\u201d of 13 other vaccines, including combination products that cover tetanus, diphtheria, polio and hepatitis A, until their makers disclose details about aluminum, an ingredient researchers <a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/36180331\/\">have associated with<\/a> a small increase in asthma cases.<\/p>\n<p>Siri declined to be interviewed, but said all of his petitions were filed on behalf of clients. Katie Miller, a spokesperson for Kennedy, said Siri has been advising Kennedy but has not discussed his petitions with any of the health nominees. She added, \u201cMr. Kennedy has long said that he wants transparency in vaccines and to give people choice.\u201d<\/p>\n<p>If the Senate confirms Kennedy as health secretary, he will oversee the FDA. In that capacity, he could take the rare step of intervening in the FDA\u2019s review of the petitions.<\/p>\n<p>Vaccines undergo <a href=\"https:\/\/historyofvaccines.org\/vaccines-101\/how-are-vaccines-made\/vaccine-development-testing-and-regulation\/\">extensive testing<\/a> before they are approved, and are monitored for safety after they come on the market. The process of taking an established drug off the market can be lengthy. The FDA would need to outline a new safety concern in writing and give the vaccine\u2019s maker a chance to respond. The FDA would then hold a hearing and render a decision. If the company did not agree with the outcome, it could sue.<\/p>\n<p>Trump and Kennedy have spoken about vaccines, the president-elect told Time magazine <a href=\"https:\/\/time.com\/7201565\/person-of-the-year-2024-donald-trump-transcript\/\">in an interview<\/a> published Thursday. Trump pledged to do \u201cvery serious testing\u201d and to get rid of some vaccines \u201cif I think it\u2019s dangerous, if I think they are not beneficial.\u201d<\/p>\n<p>During an appearance last weekend on NBC\u2019s \u201cMeet the Press,\u201d Trump said he was open to a review of vaccines and autism. But he singled out the polio vaccine as a potential exception.<\/p>\n<p>\u201cThe polio vaccine is the greatest thing,\u201d Trump said. \u201cIf someone told me get rid of the polio vaccine, they\u2019re going to have to work really hard to convince me.\u201d<\/p>\n<p>Public health experts describe the <a href=\"https:\/\/static01.nyt.com\/newsgraphics\/documenttools\/e68bd8b142eb7bf0\/914e0b90-full.pdf\">polio petition<\/a> as troubling. In 2022, an unvaccinated man in New York became paralyzed <a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/37435800\/\">after contracting polio<\/a>, and experts say the virus is still circulating worldwide.<\/p>\n<p>\u201cIt\u2019s an airplane ride away,\u201d warned Dr. Kathryn Edwards, a Vanderbilt University vaccine scientist who was subjected to one of Siri\u2019s lengthy depositions.<\/p>\n<p>Some vaccine scientists credit Siri for drilling into the details of vaccine research that he cites to make his arguments. In some cases, he aligns with vaccine scientists, <a href=\"https:\/\/pmc.ncbi.nlm.nih.gov\/articles\/PMC1448370\/\">including a team<\/a> that in 2004 called for an independent body to review vaccine safety outside agencies that fund or approve them.<\/p>\n<p>Daniel Salmon, director of the Institute for Vaccine Safety at the Johns Hopkins Bloomberg School of Public Health, said Siri raises \u201cpoints that are worthy of exploration,\u201d such as his concern about the safety of aluminum in vaccines.<\/p>\n<p>\u201cThere are issues that he raises, such as this one, that really deserve to be studied carefully,\u201d Salmon said. \u201cBut it\u2019s got to be done carefully \u2014 it\u2019s hard to do.\u201d<\/p>\n<p>Yet Siri\u2019s ascent is concerning to some doctors, who note that it comes at a time of <a href=\"https:\/\/www.cdc.gov\/mmwr\/volumes\/73\/wr\/mm7341a3.htm\">falling vaccination rates<\/a> in the United States and a <a href=\"https:\/\/www.cdc.gov\/measles\/data-research\/index.html#:~:text=Measles%20cases%20in%202024&#038;text=There%20have%20been%2016%20outbreaks,59)%20were%20outbreak%2Dassociated.\">rise in cases of measles<\/a> and <a href=\"https:\/\/www.cdc.gov\/pertussis\/php\/surveillance\/index.html\">whooping cough<\/a>. His detractors say he twists snippets of science to make questionable claims that will deepen vaccine hesitancy, threatening the system of childhood vaccines that is credited with saving millions of lives.<\/p>\n<p>One critic is Dr. Stanley Plotkin, who in the 1960s invented the <a href=\"https:\/\/historyofvaccines.org\/history\/stanley-plotkin-md\/overview\">vaccine that eliminated rubella<\/a>, a disease that killed thousands of newborns. Plotkin, who was subjected to a nine-hour deposition as an expert witness in a lawsuit brought by Siri, said having Siri in a position of influence \u201cwould be a disaster.\u201d He added: \u201cI find him laughable in many ways \u2014 except, of course, that he\u2019s a danger to public health.\u201d<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-a-fruitful-alliance\"><b>A fruitful alliance <\/b><\/h2>\n<p>Siri first made news in a vaccine case in New York City in 2015, challenging a rule that required preschool children to get an annual flu shot. He delayed the rule for several years, but lost the case on appeal.<\/p>\n<p>The work caught the attention of Bigtree, a former television producer who was winding up a national bus tour for the movie \u201c<a href=\"https:\/\/www.statnews.com\/2016\/04\/01\/vaxxed-autism-movie-review\/\">Vaxxed: From Cover-Up to Catastrophe<\/a>,\u201d which was pulled from the Tribeca Film Festival over the concerns of public health leaders.<\/p>\n<p>Bigtree has said on his podcast that he had realized he needed a capable lawyer to advance his campaign challenging vaccine safety. Through his nonprofit, which flourished during the coronavirus pandemic, Bigtree began funding Siri\u2019s legal efforts, paying his law firm $5.3 million in 2022, the most recent year records are available.<\/p>\n<p>Over the years, Siri has <a href=\"https:\/\/www.sirillp.com\/aaron-siri\/\">helped clients avoid <\/a>vaccination requirements. He won a case seeking a religious exemption from vaccines in Mississippi schools, and convinced a judge to <a href=\"https:\/\/www.sirillp.com\/newsmax-aaron-siri-discusses-san-diego-judges-ruling-against-student-vaccine-mandate\/\">strike down<\/a> a COVID vaccine mandate in San Diego public schools.<\/p>\n<p>In 2017, Siri and Bigtree joined with Kennedy to meet with the government\u2019s top vaccine experts, including Dr. Anthony Fauci, who has since retired from government service, and Dr. Francis Collins, then director of the National Institutes of Health.<\/p>\n<p>Afterward, NIH leaders worked through Kennedy\u2019s relatives to introduce him to Dr. Peter Hotez, a vaccine expert who had a daughter with autism. Hotez said he tried to explain that researchers believe autism is largely genetic and is observed in early fetal development, before vaccines are administered. \u201cRFK Jr. was deeply dug in,\u201d Hotez said. \u201cHe wasn\u2019t interested in information and the science.\u201d<\/p>\n<p>In 2018, Siri\u2019s star rose with vaccine skeptics after he deposed two renowned vaccine scientists: Plotkin and Edwards, who helped create vaccines for whooping cough and flu and one to prevent infection with a deadly bacteria, Haemophilus influenzae type B.<\/p>\n<p>Siri grilled them each for more than eight hours for two separate cases, one in Tennessee, the other in Michigan. Bigtree later posted <a href=\"https:\/\/thehighwire.com\/ark-videos\/the-deposition-of-stanley-plotkin\/\">snippets<\/a> of both depositions online, which made the doctors pariahs among vaccine skeptics.<\/p>\n<p>\u201cYou\u2019re taking the leaders in vaccinology,\u201d Edwards said, \u201cthe people that have spent their whole lives studying these vaccines and seeing their impact, you\u2019re marginalizing and making them look like they are prostitutes of pharma.\u201d<\/p>\n<p>Kennedy, who is also a lawyer, <a href=\"https:\/\/static01.nyt.com\/newsgraphics\/documenttools\/eba04919a69cf77b\/2e2b69ad-full.pdf\">joined Siri and others<\/a> in pushing the Tennessee case forward, accusing a doctor of malpractice for giving a boy a measles, mumps and rubella shot in 2001 that <a href=\"https:\/\/childrenshealthdefense.org\/defender\/william-yates-hazlehurst-autism-childhood-vaccine-injury-liability\/\">they claimed<\/a> caused his autism. They sought $75 million to cover his lifetime care.<\/p>\n<p>Kennedy sat through the trial and at the end, in early 2022, delivered closing arguments to the jury. He lost: The <a href=\"https:\/\/static01.nyt.com\/newsgraphics\/documenttools\/2359d306a6deeaac\/f69cb7e4-full.pdf\">jury ruled<\/a> in favor of the doctor.<\/p>\n<p>As Kennedy campaigned for the presidency in 2023 and this year, Siri remained at his side as his personal lawyer, exhorting federal officials to provide Kennedy with a security detail and working to remove Kennedy\u2019s name from ballots in the final days before the election.<\/p>\n<h2 class=\"wp-block-heading\" id=\"h-the-placebo-issue\"><b>The placebo issue <\/b><\/h2>\n<p>One of Siri\u2019s arguments against vaccines is that some, including the polio and hepatitis B vaccines, have not been tested against placebos in randomized, double-blind clinical trials \u2014 the gold standard for medical research, in which some patients get inert vaccines and doctors don\u2019t know which patients get which.<\/p>\n<p>He has called in his petitions for the shots to be pulled from the market until placebo-controlled trials \u2014 which would deny some children polio shots \u2014 can be completed. Given the known risks of polio causing paralysis that can seize major organs and kill people, such work is considered unethical.<\/p>\n<p>\u201cYou\u2019re substituting a theoretical risk for a real risk,\u201d said Dr. Paul A. Offit, a vaccine expert at the Children\u2019s Hospital of Philadelphia. \u201cThe real risks are the diseases.\u201d<\/p>\n<p>Siri\u2019s petition to withdraw the polio vaccine also claims that the manufacturer \u201conly assessed safety for up to three days after injection,\u201d and therefore did not meet the FDA\u2019s standard for safety.<\/p>\n<p>Ayman Chit, head of vaccines for North America at Sanofi, which makes the polio vaccine that is subject to the petition, said the vaccine has been widely used in North America and Europe and studied carefully in trials with as long as six months of safety follow-up.<\/p>\n<p>Chit said development of the vaccine began in 1977 and included more than 300 studies before and after it was approved. He said more than 280 million people had received the vaccine worldwide.<\/p>\n<p>Siri has also pushed to eliminate secrecy around government decision making. Last week, in response to a lawsuit he filed in 2021, a <a href=\"https:\/\/static01.nyt.com\/newsgraphics\/documenttools\/276364ebd1e91fda\/70a0ada9-full.pdf\">federal judge ordered<\/a> the FDA to turn over records related to authorization of the Pfizer COVID shot.<\/p>\n<p>The agency said in court filings that it has processed more than 1.2 million pages of records, spending <a href=\"https:\/\/static01.nyt.com\/newsgraphics\/documenttools\/da547fca57c1e332\/351e3f78-full.pdf\">more than $3.5 million <\/a>on \u201cunprecedented and extraordinary operations\u201d to comply with Siri\u2019s requests.<\/p>\n<p>\u201cThis is a way to hobble a public health agency like the FDA \u2014 you can just drown them in paperwork so they can\u2019t do their work,\u201d said Lawrence O. Gostin, an expert in public health law at Georgetown University.<\/p>\n<p>Siri has indicated he has no intention of stopping.
